The 2010 “short session” of the NC General Assembly is winding down with plenty of unfinished business. The Democratic leadership has refused to allow consideration of a number of important bills, primarily sponsored by Republicans.
Recent public opinion polls emphatically indicate North Carolina citizens resoundingly support these Republican initiatives. However, they have been refused a fair hearing in the legislature.
Say goodbye to the juice box. A vote of 63 to 45 in the House gave tentative approval Thursday to a measure that would dictate what children could have to drink in private child care facilities.
Senate Republican Leader Phil Berger (R-Rockingham) said, “At a time when North Carolinians are concerned about the future of their health care coverage, we cannot afford for the Governor or the Attorney General to be unengaged or reckless in their decision-making.

This legal analysis is of the constitutionality of the individual mandate provisions contained in the health care legislation as passed by the U.S. Senate (H.R. 3590 as amended) and the U.S. House (II.R. 3962). Congress’s unprecedented mandate on every citizen to purchase health insurance coverage or 10 face a penalty raises serious constitutional concerns. The U.S. Constitution enshrines a form of limited government to protect the rights of the states under a system of federalism and to protect the individual freedom of our citizens. The health care individual mandate provisions as currently drafted violate constitutional principles and lack constitutional authority for Congress to enact.
A BILL TO BE ENTITLED
AN ACT to protect the freedom to choose health care and health insurance.
(a) A law or rule shall not do any of the following:
(1) Compel a person to (i) provide for health care services or medical treatment for that person or (ii) contract with, or enroll in, a public or private health care system or health insurance plan.
Gov. Beverly Perdue has loudly proclaimed her new initiative to stop Medicaid fraud. The heart of her claim is the use of new technology by IBM to review claims before they are paid. This is a great idea.
